United States supports increasing the FAPE standard for students with disabilities!!

August 24, 2016

Hopefully good news coming soon from the Supreme Court!!

In Endrew F., an appeal out of Colorado, the United States has filed an amicus brief urging the Supreme Court to hear the appeal AND overturn the current standard in most of the country. Currently, schools can claim they only have to provide IEPs that can provide "more than a trivial benefit" to the student.

The United States argues that with the current standard: "students across the country are being denied the 'meaningful' educational benefits to which they are entitled by law."

If the Supreme Court takes this case and changes the standard, this could be very significant for students with disabilities to get the services they need!

I will keep you posted on any more developments.
